Standard Hardware Warranties
1. Warranty Information
1.1 For all newly manufacture Digital Solar Hardware the Warranty Period is specified in the Specifications. If no period of time is specified in relation to Digital Solar Hardware, then the Warranty Period for that Digital Solar Hardware is 12 months from delivery. Our warranty obligations for supplied Product are limited to the terms set out below.
1.2 Digital Solar Hardware presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the Digital Solar Hardware. Replacement under warranty will be like for like, refurbished or “as new”, meaning the replacement may have been used for testing or demonstration purposes. For Digital Solar Hardware that is capable of retaining user-generated data, repair of the goods may result in loss of such data.
1.3 The balance of the Warranty Period on the original Digital Solar Hardware will apply to the replacement Digital Solar Hardware.
1.4 The Digital Solar Hardware comes with guarantees that cannot be excluded under the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Digital Solar Hardware repaired or replaced if it fails to be of acceptable quality and the failure does not amount to a major failure.
2. Warranty Claim Procedure
2.1 To make a warranty claim, you must notify us within the Warranty Period and return the Digital Solar Hardware to us at our cost at the below address as soon as practicable after issuing the notice. When submitting a claim, you must supply us with the SKU, barcode, MAC Address and firmware level of the Digital Solar Hardware and a brief description of the problems/defects encountered.
2.2 Any warranty claim must be limited to those claims which may be asserted under the scope of the warranties provided in this document. Claims should be lodged as soon as possible after any defect in the Digital Solar Hardware is discovered.
3. Exclusions and Limitations
3.1 This warranty only covers factory imperfections in materials and workmanship and does not cover normal wear and tear.
3.2 The warranties only cover defects in materials and workmanship and do not cover normal wear and tear or loss of, or damage to, your data by the Digital Solar Hardware.
3.3 Other than as required by law and expressly specified in this document, we do not accept responsibility for everything that happens to the Digital Solar Hardware. We are not responsible for, and the warranties provided in this document will be void where:
(a) damage or fault caused by operating the Digital Solar Hardware outside the permitted or intended uses described by us or arising from your failure to follow instructions on the use of the Digital Solar Hardware;
(b) consumable parts, unless damage has occurred due to a defect in materials or workmanship;
(c) cosmetic damage, including but not limited to, scratches, dents and broken plastic on ports, that does not otherwise affect the Digital Solar Hardware’s functionality or materially impair you or your customer’s use;
(d) any abuse, misuse, neglect, mishandling or misapplication (including but not limited to, opening up, modifying or tampering with the Digital Solar Hardware);
(e) any unusual hazards affecting the Digital Solar Hardware or failure to provide an environment which is within any environment set out within the Specifications;
(f) damage, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, liquid spillage, use on an incorrect voltage, power surges and dips, thunderstorm activity, acts of God, voltage supply problems, tampering, unauthorised repairs or other acts by any persons (including any repairs by persons other than our authorised service personnel) or entry by any insect, vermin or foreign objection in the Digital Solar Hardware;
(g) if the MAC address has been altered or removed from the Digital Solar Hardware;
(h) damage arising during the transportation, installation or while moving the Digital Solar Hardware;
(i) the error, defect or restricted usability is caused by your inappropriate operation or interference;
(j) the Digital Solar Hardware has not been properly installed, maintained or operated;
(k) the Digital Solar Hardware is not certified or approved by us;
(l) or your existing system environment has been interfered with.
3.4 Matter assumes no responsibility for any warranties or representations made by other individuals or businesses beyond the express terms contained in this warranty.
3.5 Matter is not responsible or liable for loss of any programs, data, time lost in downtime or subsequent labour charges due to equipment failure. It is your responsibility to ensure adequate back-ups are made regularly.
4.1 In this document:
Digital Solar Hardware means hardware unit(s) of the type(s) specified on our website (as amended from time to time);
Matter means Matter Australia Pty Ltd ACN 130 473 595 of Suite 105, 9-11 Claremont Street, South Yarra, VIC 3141, Australia;
Specifications means the specifications for the Digital Solar Hardware specified on our website;
Warranty Period means the warranty period specified in Digital Solar Hardware Warranties or on our website;
Website means matter.solar
